"Anyday Magic" CONTEST - Contest Rules

1.

The "Anyday Magic" Contest is held by Dairy Farmers of Canada (the "Contest Organizers"). The Contest runs on the Internet from February 1, 2010 at 12:00 a.m. (ET) to November 30, 2010 at 11:59 p.m. (ET) (the "Contest Period"). The Contest Period is divided in three (3) draw entry periods (the "Periods"):

"Period 1": from February 1 at 12:00 a.m. (ET) to April 30, 2010 at 11:59 p.m. (ET);
"Period 2": from May 1 at 12:00 a.m. (ET) to August 31, 2010 at 11:59 p.m. (ET);
"Period 3": from September 1 at 12:00 a.m. (ET) to November 30, 2010 at 11:59 p.m. (ET).

ELIGIBILITY

The Contest is open to residents of Ontario, New-Brunswick, Nova Scotia and Prince Edward Island who have reached the age of majority in their province of residence. Employees, agents and representatives of the Contest Organizers, of any company, corporation, trust or other legal entity controlled by or affiliated to them, their advertising and promotional agencies, suppliers of prizes, material and services related to this Contest, as well as members of their immediate family (brothers, sisters, children, father, mother), their legal or common-law spouse and any individuals with whom such employees, agents and representatives are domiciled, are not eligible. "Cookies" must be accepted to enter the Contest.

To enter go to www.anydaymagic.ca. On the home page, click on "Conjure up a surprise" to find out what will be revealed by the mystery box.

INSTANT PRIZES

If the mystery box on the screen reveals an instant prize, correctly answer the first mathematical skill-testing question. Then, click on "Submit" to access the electronic entry form (the "Entry Form") to claim your instant prize and to enter in one of the grand prize draw (there will be a grand prize draw for each Period). Within the next ten (10) minutes:

Fill out the Entry Form by entering your first name, last name, street address, city, postal code, e-mail address, province and the correct answer to the second mathematical skill-testing question, which is required for your entry in a grand prize draw;

4.2

Type the code as shown on the page for security purposes;

4.3

Declare that you have reached that age of majority in your province of residence and that you have read and agreed to the Contest Rules by checking the corresponding box;

4.4

Click on "Submit" no later than November 30, 2010 at 11:59 p.m. (ET). You will receive a confirmation message. Within the next twenty-four (24) hours, click on the link in the confirmation message to validate your e-mail address, claim your instant prize and confirm your entry in a grand prize draw. You will obtain one (1) entry in the grand prize draw of the Period in which you clicked on the link in the confirmation message. Entrants who click on the link between November 30, 2010 at 11:59 p.m. (ET) and December 1, 2010 at 11:59 p.m. (ET) will obtain one (1) entry in the grand prize draw of Period 3.

If the mystery box reveals a tip, shows "Sorry" or if you have incorrectly answered the first mathematical skill-testing question to win an instant prize, you may still enter into a grand prize draw. Follow the instructions on the screen to fill out the grand prize draw Entry Form, in compliance with sections 4.1 to 4.3 and click on "Submit". You will receive a confirmation message. Click on the link in the confirmation message no later than November 30, 2010 at 11:59 p.m. (ET) to validate your e-mail address and obtain your entry in a grand prize draw. You will obtain one (1) entry in the grand prize draw of the Period in which you clicked on the link in the confirmation message.

GRAND PRIZE DRAWS

You may also directly enter a grand prize draw without going through section 3 of these Contest Rules. To proceed, go to www.anydaymagic.ca. On the home page, click on "Enter to win" and follow the instructions on the screen to fill out the grand prize draw Entry Form, in compliance with sections 4.1 to 4.3. Then click on "Submit" to obtain one (1) entry in the grand prize draw of that Period. You will receive a confirmation message. Click on the link in the confirmation message no later than November 30, 2010 at 11:59 p.m. (ET) to validate your e-mail address and obtain your entry in a grand prize draw. You will obtain one (1) entry in the grand prize draw of the Period in which you clicked on the link in the confirmation message.

7.

Limits. Entrants must respect the following limits otherwise they may be disqualified:

7.1

You may click on "Conjure up a surprise" only once a day, no matter what is revealed in the mystery box;

7.2

One (1) grand prize draw entry per e-mail address and per day;

7.3

The use of only one (1) e-mail address when an entrant has more than one.

8.

Instant prizes. There is a total of two hundred (200) instant prizes to win during the Contest Period. Prize description, value and quantity are:

8.1

The following conditions apply to instant prizes:

a)

The gift card/certificate may be used to purchase products and/or services online or in store, as the case may be;

b)

The gift card/certificate may be used more than once, subject to any other restriction to the contrary by the issuer;

c)

The gift card/certificate is not refundable and may not be exchanged in whole or in part for cash;

d)

Chapters Indigo gift cards are not redeemable for cash and may be redeemed for merchandise at any Chapters, Indigo, Coles or World's Biggest Bookstore, or online at chapters.indigo.ca. Chapters, Indigo and Coles are registered trademarks of Indigo Books & Music Inc., used under license;

e)

The gift card/certificate is valid for the period communicated by the issuer and no credit or refund will be given if the gift card/certificate is not used within the stipulated timeframe;

f)

The gift card/certificate may not be combined with any other promotion or offer;

g)

The gift card/certificate is subject to any other restrictions or conditions stipulated on it or that may be communicated by the issuer or the store visited by a winner, as the case may be.

8.2

Odds of winning an instant prize. During the Contest period there are 200 instant prizes to win with one instant prize per day at a precise time of day. The days on which an instant prize is offered, the daily instant prize and the precise time of day have been preselected at random before the beginning of the contest. The number of instant prizes will decrease as they are won.

9.

Grand prizes. There are three (3) grand prizes to win:

9.1

Two (2) KitchenAid Stand Mixer (model 4KG25H3XOB), of an approximate retail value of $400 each.

9.2

One (1) Cuisinart Ice Cream Maker (model ICE-30BCC), of an approximate retail value of $100.

The colour of these grand prizes is at the sole discretion of the Contest Organizers.

10.

Limit. There is a limit of one (1) instant prize per person per day and one (1) grand prize per person per household for the Contest Period.

DRAWS

11.

At 12:00 p.m. (ET) on May 3, 2010 at the office of the agency in charge of the conduct of the Contest located in Montreal, a random draw of one (1) eligible entry will be held among all draw entries registered during Period 1 to award one of the grand prizes described at section 9.1.

12.

At 12:00 p.m. (ET) on September 1, 2010 at the office of the agency in charge of the conduct of the Contest located in Montreal, a random draw of one (1) eligible entry will be held among all draw entries registered during Period 2 to award the grand prize described at section 9.2.

13.

At 12:00 p.m. (ET) on December 2, 2010 at the office of the agency in charge of the conduct of the Contest located in Montreal, a random draw of one (1) eligible entry will be held among all draw entries registered during Period 3 to award one of the grand prizes described at section 9.1.

14.

Odds of winning a grand prize. The odds of an entrant's entry being selected depend on the number of eligible draw entries registered during the Period preceding the draw. Draw entries are not cumulative from one Period to another.

AWARDING OF GRAND PRIZES

15.

To be declared a winner, any selected entrant must:

Be reached by e-mail within ten (10) days of a draw. He/she must reply in accordance with the instructions given in the e-mail, as the case may be. Return of an e-mail prize notification as undeliverable will result in disqualification and selection of an alternate entrant;

15.2

Have correctly answered the mathematical skill-testing question on the Entry Form;

15.3

Fill out and sign the Declaration and Release Form (the "Declaration Form") that the Contest Organizers will provide him/her by mail, fax or e-mail to the effect that he/she has fulfilled all the requirements of these Contest Rules, and return it to the Contest Organizers for them to receive it within ten (10) days of its receipt;

15.4

Upon request and in a timely manner, provide an identification card with photograph.

16.

Failure to comply with one of the conditions mentioned in these Contest Rules or to accept a prize will cause the selected entrant of a prize to be disqualified. In such a case, the Contest Organizers may, at their sole discretion, cancel the prize, hold a new draw in compliance with these Contest rules until an entrant is selected and declared a winner in the case of a grand prize or, in the case of an instant prize, offer it on another day during the Contest Period by using the procedure explained at Section 8.2. In the event that no entrant has been declared a winner of a grand prize within sixty (60) days following the original draw, the Contest Organizers may cancel the grand prize.

17.

Within two (2) to six (6) weeks following the claim of an instant prize, instant prize winners will receive their prize by mail or will receive instructions by e-mail on how they may redeem their prize online, as the case may be. Within two (2) to four (4) weeks following the receipt of the duly completed and signed Declaration Form, the Contest Organizers will have the prize delivered to the winners of a grand prize.

GENERAL CONDITIONS

18.

Verification. Entry Forms and Declaration Forms are subject to verification by the Contest Organizers. Any Entry Form or Declaration Form which is, as the case may be, incomplete, illegible, mutilated, fraudulent, registered or submitted late, bearing an invalid e-mail address, not bearing the correct answer to the mathematical skill-testing question or otherwise noncompliant shall be rejected and will not entitle to an entry or to a prize, as the case may be.

19.

Disqualification. The Contest Organizers reserve the right to disqualify a person or to cancel one or several entries of a person who participates or tries to participate in this Contest by using methods that do not comply with these Contest Rules or that are unfair to other entrants (e.g. entries exceeding the authorized limit). Such a person may be reported to the appropriate legal authorities.

20.

Conduct of the Contest. Any attempt to deliberately damage the Contest web site and/or any related web site or to sabotage the legitimate conduct of this Contest constitutes a violation of civil and criminal laws. Should there be any such attempts, the Contest Organizers reserve the right to reject the entrant's entries and obtain legal or equitable relief under applicable laws.

21.

Acceptance of prize. Prizes must be accepted as described in these Contest Rules and may not, in any case, be in whole or in part transferred to another person, replaced by another prize or exchanged for cash, except as provided in the section below.

22.

Substitution of prize. In the event where it would be impossible, difficult and/or more costly for the Contest Organizers to award a prize (or a portion thereof) as described in these Contest Rules, they reserve the right to award a prize (or portion thereof) of the same kind and of equivalent value or, at their sole discretion, the cash value of a prize (or portion thereof) as indicated in the Contest Rules.

23.

Liability limit: use of the prize. By entering the Contest, any entrant selected for a prize releases and holds harmless the Contest Organizers, any company, corporation, trust or other legal entity controlled by or affiliated to them, their advertising and promotional agencies, their employees, agents and representatives (the "Released Parties") from and against any damage resulting from the acceptance or use of the prize.

24.

Liability limit: prize supplier. Any entrant selected for an instant prize acknowledges that upon receipt of the gift card/certificate or instructions on how he/she may redeem his/her gift card/certificate, the execution of the services and obligations related to it becomes the responsibility of the different providers of goods and services related to it.

25.

Prize warranty. Any entrant selected for a gift card/certificate or a grand prize acknowledges the only warranty applicable to a grand prize or to the products and services obtained with a gift card/certificate, as the case may be, is the standard warranty of the manufacturer or suppliers of services.

26.

Web site. The Contest Organizers do not warrant that access to or use of the Contest web site will be uninterrupted during the Contest Period or error-free.

27.

Liability limit: conduct of the Contest. The Released Parties disclaim all liability for any of the following that may limit or prevent any entrant's participation in the Contest: malfunctioning of any computer component, software or communications line; loss or lack of a communications network; or any transmission that is faulty, incomplete, incomprehensible or erased by any computer or network. The Released Parties also disclaim all liability for any damages or loss that may be caused, directly or indirectly, in whole or in part, by the downloading of any web page or software or by the transmission of any information related to participation in the Contest.

28.

Contest modification. The Contest Organizers reserve the right, at their sole discretion, to cancel, terminate, modify or suspend this Contest in whole or in part, should human intervention or an event take place that could alter or affect the administration, security, impartiality or conduct of the Contest as provided in these Contest Rules.

29.

Termination of participation in the Contest. In the event that the computer system cannot register all Contest draw entries during a Period for whatever reason, or if participation in the Contest must be terminated in whole or in part before the closing date of a Period, the Contest Organizers may, at their sole discretion, proceed with the draw among the draw entries duly registered during that Period or since the beginning of a Period up to the date of the event ending participation in the Contest for that Period, as the case may be. If a Period does not take place, the grand prize for that Period will be cancelled.

30.

Prize limit. In no event shall the Contest Organizers be required to award more prizes than indicated in these Contest Rules or to award a prize otherwise than in compliance with these Contest Rules.

31.

Liability limit: participation in the Contest. Persons who enter or try to enter this Contest release the Released Parties from any liability for damage these said persons may incur as a result of their entry or their attempt to enter the Contest.

32.

Authorization. By entering this Contest, any entrant selected for a prize authorizes the Contest Organizers and their representatives to use, if required, his/her name, photo, likeness, voice, place of residence and/or statement regarding a prize for publicity purposes, without any form of compensation.

33.

Communication with entrants. No communication or correspondence related to this Contest shall be exchanged with entrants except as provided for in these Contest Rules or at the Contest Organizers' initiative.

34.

Personal information. Entrants' personal information collected for the purpose of the Contest will only be used to administer the Contest. No commercial or other communications unrelated to the Contest will be sent to entrants unless they have otherwise agreed to receive such communications.

35.

Property. Declaration Forms are the property of the Contest Organizers and shall not in any case be returned to entrants.

36.

Entrant identification. For the purpose of these Contest Rules, the entrant is the person whose name appears on the Entry Form and it is to this person to whom a prize will be awarded if he/she is selected and declared a winner.

37.

Contest Organizers' decision. Any decision by the Contest Organizers or their representatives regarding this Contest is final and without appeal.

38.

Contest organization. Apple is not a participant or sponsor of this Contest.

39.

Unenforceability. If a section of the Contest Rules is declared or deemed illegal, unenforceable or invalid by a competent court, that section shall be considered invalid, but all unaffected sections will be applied within the limits of the law.
